ESalesGuru Mediation Service

The ESalesGuru Mediation Service is available for those members who have a particular dispute or disagreement with another member and have not been able to resolve the issues independently. Our in-house mediation team is committed to helping bring resolution where possible to any disputes occurring between ESalesGuru Employers and Professionals.

While we certainly cannot guarantee the dispute will be resolved to your satisfaction, our mediation team will do the following to bring about a mutually agreeable situation:


1. Review message board correspondence and the service agreement between the two parties.

Our mediation team typically will review the Personal Message Board correspondence between the two parties in order to gain a better understanding as to the flow of communication in this disputed project. It is essential to have an executed Service Agreement for this disputed project including project details, contact information and payment terms uploaded to your message board so we can clearly review the agreed upon terms. We also recommend making the ESalesGuru Message Board your primary mode of communication as it helps us to track correspondence when these disputes arise.


2. Contact one or both parties involved in the dispute to re-establish lines of communication.

One of the goals during this mediation process is to get the two parties communicating again in order to move towards a mutually agreeable resolution to the dispute or disagreement. Our Mediation team will connect with one or both parties to hear their side of the issue and work on bringing the two parties together for further discussions.


3. Based on the reviewed information, the mediation team will make recommendations for resolution.

It is very important to us that your dispute is resolved in a timely and appropriate manner. Once we have had the opportunity to adequately review all the information and connect with the involved parties, we will then make some recommendations for resolution.

If during the investigation process, we determine one or both members are violating the Terms and Conditions of ESalesGuru.com, then we reserve the right to suspend or terminate the membership(s) if necessary.


4. If the dispute remains unresolved, the ESalesGuru Mediation Team will recommend 3rd party intervention to assist in this particular issue.

If the ESalesGuru Mediation Process is not able to bring about a mutually agreeable resolution, then our Mediation team will recommend that you involve a Professional 3rd party mediator or a certified dispute resolution service to assist in establishing an agreement. 

If the dispute involves "Feedback" we also recommend reviewing the Feedback Policy in our Terms and Conditions to see those instances where we might consider changing or deleting particular feedback.
